By completing payment, clicking "I Agree," or accessing the Service, you agree to be bound by these Terms. If you are entering these Terms on behalf of a company, you represent that you have authority to bind that entity. If you do not agree to these Terms, do not complete payment or access the Service.
BasinStrata delivers a weekly Permian Basin drilling data platform including:
The weekly report is delivered every Monday morning (CST) excluding federal holidays. We aim to maintain continuous access to basinstrata.com/report but do not guarantee 100% uptime.
Flexible Plan subscribers may cancel with 14 days written notice at any time.
Annual Plan subscribers agree to a 12-month minimum commitment. You are financially responsible for all fees through the end of the Initial Term regardless of use.
Annual Upfront Plan subscribers pay for a full 12 months in advance. Access begins immediately upon confirmed payment. Non-refundable except as required by law.
Annual Plan and Annual Upfront Plan subscribers have their price locked for the duration of their Initial Term. No price increases during an active commitment period.
Annual Plan subscriptions auto-renew for successive 12-month periods at the prevailing rate unless you cancel in writing at least 30 days before your renewal date.
Annual Upfront Plan subscriptions do NOT auto-renew. You will be contacted 30 days before expiration.
All fees are non-refundable except as required by law or termination by BasinStrata without cause. No refunds for partial months, unused access, or early cancellation.
If payment fails we will notify you within 24 hours and retry up to 3 times over 7 days. Access suspended after 7 days of non-payment. Subscription terminated after 30 days.
If you received a trial period, your commitment begins on your first payment date. Trial periods do not count toward the commitment term. If you do not cancel before the trial ends, subscription begins automatically.
Your access code is issued to your company only and may not be shared outside your organization.
You may use the Service solely for internal business development and sales prioritization.
You may NOT:
Violation results in immediate termination without refund and potential legal action.
All data is sourced from Texas Railroad Commission public permit filings. BasinStrata is not affiliated with or endorsed by the RRC.
WE MAKE NO WARRANTY REGARDING THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY INFORMATION IN THE SERVICE.
Execution probability scores are statistical projections, not guarantees of drilling activity.
CapEx estimates are directional and may vary significantly from actual costs. Not suitable for budgeting or financial modeling.
Permit filing does not guarantee that a well will be drilled on any timeline or at all.
Estimated spud dates are statistical estimates only, not operator commitments.
NOTHING IN THE SERVICE CONSTITUTES INVESTMENT, FINANCIAL, LEGAL, OR BUSINESS ADVICE.
All scoring algorithms, models, report formats, software, and analytical frameworks are the exclusive property of BasinStrata.
We grant you a limited, non-exclusive, non-transferable license to access and use the Service for internal business purposes during your active subscription only.
You agree to keep confidential: your access code, subscription pricing, and any non-public information about BasinStrata methodology.
Weekly reports are for your internal use only. Do not forward, publish, or distribute report content to any third party without prior written consent.
Confidentiality obligations survive termination for 3 years.
We collect your name, company, email, billing information, and usage data to provide the Service. We do not sell your personal information.
Payment data is processed by Stripe, Inc. We do not store full payment card information.
We retain your account information for the duration of your subscription plus 3 years.
Flexible Plan: Cancel anytime with 14 days written notice to gad@basinstrata.com.
Annual Plan: Cancel in writing anytime. Cancellation effective at end of 12-month commitment. If cancelled early without cause, 50% of remaining monthly fees are owed.
Annual Upfront Plan: Non-cancellable for refund purposes. Access ceases at end of paid year.
We may terminate your access immediately if you violate Section 4, fail to pay within 30 days, or provide false information.
Upon termination your access code is immediately deactivated. No refunds except as stated in Section 3.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BASINSTRATA IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES INCLUDING LOST REVENUE OR MISSED OPPORTUNITIES.
OUR TOTAL LIABILITY SHALL NOT EXCEED FEES PAID BY YOU IN THE 3 MONTHS PRECEDING THE CLAIM.
WE ARE NOT LIABLE FOR ERRORS IN GOVERNMENT DATA FROM THE TEXAS RAILROAD COMMISSION OR ANY THIRD PARTY SOURCE.
WE ARE NOT LIABLE FOR BUSINESS DECISIONS MADE BASED ON SERVICE DATA OR ANALYSIS.
You agree to indemnify and hold harmless BasinStrata from any claims, damages, losses, or expenses arising from your use or misuse of the Service, violation of these Terms, or violation of any third party rights.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We are not liable for failure or delay caused by circumstances beyond our reasonable control including acts of God, government action, internet failures, pandemic, or failure of third-party providers including the Texas Railroad Commission or Stripe.
These Terms are governed by the laws of the State of Florida.
Any legal action must be brought in the courts of the State of Florida.
Before filing any legal claim, contact gad@basinstrata.com and allow 30 days for informal resolution.
YOU AND BASINSTRATA AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A CLASS OR REPRESENTATIVE ACTION.
These Terms constitute the entire agreement between you and BasinStrata regarding the Service.
We may update these Terms with 30 days written notice. Continued use after notice constitutes acceptance.
You may not assign these Terms without our prior written consent.
Electronic acceptance, completing payment, clicking "I Agree," or accessing the Service, has the same legal effect as a written signature.
